John is originally from Salisbury, Maryland. He received a four-year ROTC scholarship to attend college at the Furman University located in Greenville, South Carolina. In 1996, John graduated Magna Cum Laude from Furman with a B.A. in Accounting, and received an academic delay from the United States Army to attend law school. In 1999, John graduated Magna Cum Laude from the University of Tennessee College of Law. While in law school, John received several academic honors including Dean’s List, Highest Honors, Two Certificates of Academic Excellence (Land Finance Law and Advocacy Clinic), and James L. Powers III Excellence in Criminal Advocacy Award (1998-1999 Year). He also placed 2nd in the Ray Jenkins Mock Trial Competition.

John began his legal career in January 2000 for the United States Judge Advocate General’s Corps. He was stationed at Fort Riley, Kansas for four years, during which time he served in several different legal positions. However, most of John’s time in the Army was devoted to being a criminal prosecutor. During his time at Fort Riley, John successfully prosecuted over 150 felony cases for crimes such as murder, rape, arson, theft, child molestation, and drug crimes. He also served as lead counsel in several jury trials, judge alone trials, and sentencing hearings.

After being honorably discharged from the Army in 2004, John dedicated a year working on the renovation of the Wilkinson-Keele house. During this time, he also expanded his legal skills by working various legal assignments for Counsel on Call.

In 2005, John and Chasity opened the Law Office of Nicoll & Nicoll. Since then, John has practiced primarily as a criminal defense attorney. In that capacity, he has represented hundreds of clients in state court charged with various crimes including first degree murder, second degree murder, aggravated arson, felony drug possession, aggravated robbery, theft, burglary, and driving under the influence (DUI).

In 2006, John had to put all of his experience and training to work when he was appointed to represent an indigent defendant charged with the murder of his girlfriend. Despite the client’s claim that the shooting was accidental, the police charged him with second degree murder. John spent several hundred hours over the next two years interviewing witnesses, finding experts, examining evidence, and preparing the case for trial. After a five day jury trial, John and Chasity were able to convince the jury that the client was not guilty, and ultimately, the client was acquitted.

In 2007, John began to focus part of his practice on the representation of criminal defendants in the federal courts of Tennessee. Over the past three years, he has represented numerous clients charged with various federal crimes. Federal criminal law is vastly different than state criminal law. Oftentimes, the penalties associated with federal crimes include mandatory minimum periods of incarceration and harsh guideline ranges of punishment. Despite this, John has been able to effectively persuade the court to impose penalties far below the applicable guideline range of punishment on several occasions.

He is currently licensed to practice law in the state of Tennessee, the Federal District Court for the Middle District of Tennessee, and the Federal District Court for the Eastern District of Tennessee, and the Sixth Circuit Court of Appeals. He now practices in the areas of federal, state, and military criminal defense.
